à nous - DISTANCE SALES CONTRACT

Article 1. Parties This Online Membership Agreement and Terms of Use ("Agreement") is entered into by and between Hilal Yast Sole Proprietorship, the legal owner and operator of the website anous.co (including its mobile and web-based applications, hereinafter referred to as the “Site”), and the individual user ("Customer") who creates a membership account or purchases a product through the Site.

By accessing or using the Site, the Customer accepts and agrees to be bound by the terms of this Agreement.

Article 2. Purpose of the Agreement This Agreement governs the rights and obligations of the Parties regarding the sale and delivery of products ordered electronically by the Customer via the Site, in accordance with the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts. The Customer acknowledges that they have read and understood all preliminary information related to the product, including its essential features, price, payment method, and delivery conditions, and confirmed this electronically prior to placing the order.

Article 3. Product Delivery The product will be delivered to the delivery address specified by the Customer during the order process. Delivery shall be made to the individual named at that address.

Article 4. Delivery Fees and Fulfillment Delivery costs are the responsibility of the Customer. However, if the Site advertises free delivery above a certain order amount or under a promotional campaign, those conditions shall apply. Orders are shipped as soon as possible following payment confirmation. If the product price is not paid or the transaction is canceled in bank records, the Seller is not obligated to deliver the product.

Article 5. Customer Declarations and Commitments The Customer agrees to inspect the product upon delivery and shall not accept damaged, defective, or unsealed packages. Products accepted at delivery shall be considered undamaged and complete. The Customer is responsible for protecting the product after delivery. If payment is reversed by the bank due to unauthorized use of the Customer's credit card, the Customer must return the delivered product to the Seller within three (3) days. All associated shipping costs are the responsibility of the Customer.

Article 6. Seller Declarations and Commitments The Seller is responsible for delivering the product in full, undamaged, and as described, along with any applicable documentation or manuals. If the product is to be delivered to a third party designated by the Customer and this person refuses to accept it, the Seller cannot be held liable. If the Seller is unable to fulfill the order, the Customer will be notified before the contractual deadline and any payments made will be refunded within ten (10) days.

Article 7. Product Specifications The type, quantity, brand/model, color, and total price (including taxes) of the product are detailed on the product page of the Site and the invoice, which form an integral part of this Agreement.

Article 8. Product Price The total price of the product, including all taxes, is included in the invoice delivered to the Customer.

Article 9. Payment Terms If the Customer pays in installments via credit card, the selected installment plan applies. The payment schedule and interest (if any) are determined by the Customer’s agreement with their bank. The Customer is responsible for tracking their payments via their bank.

Article 10. Right of Withdrawal Products sold on anous.co are second-hand or vintage, and may include accessories and intimate apparel (e.g. bustiers). In accordance with Article 15/1-ç of the Distance Contracts Regulation, such items are not eligible for return due to hygiene concerns. By accepting this Agreement, the Customer acknowledges that they are aware of this limitation and agree not to exercise a right of withdrawal.

In case of a valid issue, Customers may request a product exchange within three (3) days of delivery. To qualify for an exchange:

  • The product must be unused and undamaged
  • The product must be returned in its original box, packaging, and with all included accessories
  • Items that show signs of wear or damage will not be accepted

Accessories (such as shoes, bags, sunglasses, belts) are not eligible for return or exchange.

The Customer also acknowledges that the products are second-hand and may show reasonable wear or fading that does not prevent usage. The Seller is not responsible for issues such as shrinkage or fading due to improper care or washing. Gift cards and store credit cannot be returned or refunded in cash.

Article 11. Default and Legal Consequences If the Customer defaults on installment payments made via credit card, they will be liable under the terms of their agreement with the bank. In such cases, the bank may pursue legal action and claim collection costs and attorney fees from the Customer. The Customer agrees to compensate the Seller for any damages resulting from delayed payment.

Article 12. Jurisdiction For disputes arising under this Agreement, the Customer may apply to the Consumer Arbitration Committee or Consumer Court in accordance with the value thresholds set by the Ministry of Trade of the Republic of Turkey.

 

à nous - MESAFELİ SATIŞ SÖZLEŞMESİ

Madde 1. Taraflar
İşbu Online Üyelik Sözleşmesi ve Kullanım Şartları (“Sözleşme”); anous.co internet sitesinin (mobil ve web tabanlı uygulamaları dahil, bundan böyle “Site” olarak anılacaktır) yasal sahibi ve işletmecisi olan Hilal Yast Şahıs Şirketi ile Site üzerinden üyelik hesabı oluşturan veya ürün satın alan gerçek kişi “Müşteri” arasında akdedilmiştir.
Site’ye erişerek veya Site’yi kullanarak, Müşteri bu Sözleşme hükümlerine bağlı kalmayı kabul ve taahhüt eder.

Madde 2. Sözleşmenin Konusu
İşbu Sözleşme, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği uyarınca, Müşteri’nin Site üzerinden elektronik ortamda siparişini verdiği ürünün satışı ve teslimine ilişkin tarafların hak ve yükümlülüklerini düzenler.
Müşteri, sipariş vermeden önce ürünün temel nitelikleri, satış fiyatı, ödeme şekli ve teslimat koşullarına ilişkin tüm ön bilgileri incelediğini, anladığını ve elektronik ortamda onayladığını kabul eder.

Madde 3. Ürün Teslimatı
Ürün, Müşteri tarafından sipariş sırasında belirtilen teslimat adresine ve adreste ismi belirtilen kişiye teslim edilir.

Madde 4. Teslimat Ücreti ve İfa
Teslimat ücreti, aksi promosyon veya kampanya koşullarında belirtilmedikçe Müşteri’ye aittir (ör. belirli bir tutar üzeri ücretsiz kargo kampanyaları). Siparişler, ödeme onayının ardından en kısa sürede kargoya verilir.
Ürün bedeli ödenmediği veya banka kayıtlarında iptal edildiği takdirde, Satıcı’nın ürünü teslim yükümlülüğü bulunmaz.

Madde 5. Müşteri Beyan ve Taahhütleri
Müşteri, teslimatta ürünü kontrol etmek ve hasarlı, bozuk veya ambalajı açılmış paketleri teslim almamakla yükümlüdür. Teslim alınan ürün, eksiksiz ve hasarsız olarak kabul edilir.
Teslimattan sonra ürünün muhafazası Müşteri’nin sorumluluğundadır.
Banka tarafından kredi kartının yetkisiz kullanımı nedeniyle ödemenin iptali halinde, Müşteri teslim edilen ürünü üç (3) gün içinde Satıcı’ya iade etmekle yükümlüdür. İade kargo ücretleri Müşteri’ye aittir.

Madde 6. Satıcı Beyan ve Taahhütleri
Satıcı, ürünü eksiksiz, hasarsız ve satışta belirtildiği şekilde, varsa kullanım kılavuzu ve ilgili belgeler ile birlikte teslim etmekle yükümlüdür.
Ürünün, Müşteri’nin belirlediği üçüncü kişiye teslim edilmesi halinde, bu kişinin teslimatı kabul etmemesi durumunda Satıcı sorumlu tutulamaz.
Satıcı’nın siparişi ifa edememesi halinde, Müşteri sözleşme süresi dolmadan bilgilendirilir ve yapılan ödemeler on (10) gün içinde iade edilir.

Madde 7. Ürün Özellikleri
Ürünün türü, miktarı, markası/modeli, rengi ve vergiler dahil toplam satış bedeli; Site’de yer alan ürün sayfasında ve faturada belirtilir. Bu belgeler, işbu Sözleşme’nin ayrılmaz bir parçasıdır.

Madde 8. Ürün Bedeli
Ürünün vergiler dahil toplam satış bedeli, Müşteri’ye teslim edilen faturada yer alır.

Madde 9. Ödeme Şartları
Taksitli ödeme seçilmesi halinde, Müşteri’nin seçtiği taksit planı geçerli olur. Ödeme planı ve uygulanacak faiz oranları, Müşteri ile bankası arasındaki anlaşmaya tabidir. Müşteri, ödeme planını bankası aracılığıyla takip etmekle yükümlüdür.

Madde 10. Cayma Hakkı ve Değişim Politikası
anous.co üzerinden satılan tüm ürünler ikinci el veya vintage ürünlerdir; bunlar arasında aksesuarlar ve iç giyim ürünleri (ör. büstiyerler) yer alabilir.
Mesafeli Sözleşmeler Yönetmeliği Madde 15/1-ç uyarınca, bu tür ürünlerde hijyen gerekçesiyle cayma hakkı bulunmamaktadır. Müşteri, bu Sözleşmeyi kabul etmekle birlikte bu sınırlamayı bildiğini ve kabul ettiğini beyan eder.

Geçerli bir sorun olması halinde, Müşteri teslimattan itibaren üç (3) gün içinde değişim talep edebilir. Değişim talebi şu şartlara tabidir:

  • Ürün kullanılmamış ve hasarsız olmalıdır
  • Ürün, orijinal kutusu/ambalajı ve tüm aksesuarları ile birlikte iade edilmelidir
  • Kullanım izleri veya hasar tespit edilen ürünler kabul edilmez

Aksesuarlar (ayakkabı, çanta, güneş gözlüğü, kemer vb.) iade veya değişim kapsamı dışındadır.
Müşteri, ikinci el ürünlerde kullanım amacını engellemeyen makul ölçüde yıpranma veya solma olabileceğini kabul eder. Satıcı, yanlış bakım veya yıkamadan kaynaklanan çekme veya solmalardan sorumlu değildir.
Hediye kartları ve mağaza kredileri nakde çevrilemez veya iade edilemez.

Madde 11. Temerrüt ve Hukuki Sonuçlar
Müşteri, kredi kartı ile yapılan taksitli ödemelerde temerrüde düşmesi halinde bankası ile yaptığı sözleşme hükümlerine tabidir.
Banka, yasal takip başlatabilir ve tahsilat masrafları ile avukatlık ücretlerini talep edebilir. Müşteri, gecikmeden kaynaklanan Satıcı zararlarını tazmin etmeyi kabul eder.

Madde 12 . Yetkili Mercii
İşbu Sözleşme’den doğabilecek uyuşmazlıklarda, Müşteri Tüketici Hakem Heyeti veya Tüketici Mahkemesi’ne, Ticaret Bakanlığı tarafından belirlenen parasal sınırlar çerçevesinde başvurabilir.
